ABSTRACT
Summary: Legal issues related to the implementation of strategic planning in the field of national security have been known for about 30 years. Over the years, a number of measures have been taken to regulate strategic planning issues, but most of them have not even gone beyond the conceptual stage. No uniform concept for the legal regulation of strategic planning issues in the field of security has ever been presented, and at most, individual legal regulations have been adopted. This problem has been pointed out for many years in scientific literature, including, for example, in relation to the manner of preparation and content of the National Security Strategy, including its life cycle. Documents concerning operational planning, such as the Political-Strategic Defense Directive, plans for the use of the Polish Armed Forces, and the Polish Defense Response Plan, require particular attention. The identified doubts regarding the application of the law make it necessary to regulate these issues by statute, as they relate to the competences of state authorities and, in the event of military operations, also to economic entities and citizens. Inadequate or unclear legal provisions can effectively destabilize preparations for a defense operation and its conduct, creating chaos in terms of competences and paralyzing decision-making. Purpose and research methods: The aim of this article is to attempt to develop a unified concept of legal regulation of strategic planning issues in the sphere of security. Research method: comparative analysis Conclusions / recommendations: The identified doubts regarding the application of the law make it necessary to regulate these issues by statute, as they relate to the competences of state authorities and, in the event of military operations, also to economic entities and citizens.
